Delegation of Authority--Approval of Project Design

At the January 2003 meeting, The Regents amended the University policy on capital project design approvals and added new sections on Long Range Development Plan amendments and California Environmental Quality Act administration. The policy pertaining to design approval states in part:

(1) The Regents designate the following categories of projects as requiring design approval by the Committee on Grounds and Buildings:

a. Building projects with a total project cost in excess of $10,000,000, except when such projects consist of the following:

i. Alterations or remodeling where the exterior of the building is not materially changed;

ii. Buildings or facilities located on agricultural, engineering, or other field stations; or

iii. Agriculture related buildings or facilities located in areas of a campus devoted to agricultural functions.

b. Capital improvement projects of any construction cost when, in the judgment of the President, a project merits review and approval by The Regents because of budget matters, fundraising activities, environmental impacts, community concerns, or other reasons.

Effective immediately, the authority to approve projects with a total individual project cost in excess of $5,000,000 and up to $10,000,000 is delegated to the Senior Vice President--Business and Finance. Redelegation of the above authority shall be in writing with copies to the Special Assistant--Coordination and Review, the General Counsel and Vice President for Legal Affairs, and the Secretary of The Regents.

Effective immediately in their respective areas of responsibility, Chancellors, the Director of the Lawrence Berkeley National Laboratory, the Senior Vice President--Business and Finance, and the Vice President--Agriculture and Natural Resources are delegated the authority to approve the design for projects with a total individual project cost not exceeding $5,000,000. This delegation shall not apply to any project for which the President has given notice that Regental approval is merited under section (1) b. of the policy. Any redelegation of this authority shall be in writing with copies to the Senior Vice President-Business and Finance, the Special Assistant--Coordination and Review, the General Counsel and Vice President for Legal Affairs, and the Secretary of The Regents.

The foregoing delegations of authority are applicable to all projects on property owned by The Regents or on property which will be owned by The Regents upon completion of the project, including campus inclusion land. Total individual project cost shall be defined as all costs of the project including administrative, design, construction, interest during construction, and equipment costs.

This delegation supersedes the April 5, 1984 delegation of authority to Chancellors, the Director--Lawrence Berkeley Laboratory (now Lawrence Berkeley National Laboratory), the Senior Vice President--Business and Finance, and the Vice President--Agriculture and Natural Resources on this same subject (DA 0810).
